1. Introduction & Acceptance of Terms

Welcome to the website of Greenhill Fruit Farm Limited (“we”, “us”, “our”, or “the Farm”), operating under the trading name Greenhill Fruit Farm / GreenHill Fruit Farm.

These Terms and Conditions (“Terms”) govern your access to and use of our website at https://greenhillfruitfarm.com (the “Website”), as well as any purchases of our products (fresh fruit, frozen fruit, jams and related produce) made through our roadside sales units, farm premises, wholesale arrangements, or any other sales channel, and any corporate event or catering services we provide.

By accessing the Website, purchasing our products, or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use the Website or purchase from us.

We are a family-run soft fruit farm with three generations of expertise, producing premium strawberries, raspberries, blackberries, blueberries, gooseberries, cherries and related products using both traditional and modern (table-top) growing methods. Our fruit is available via roadside sales units across Ireland, wholesale and retail channels, and selected food-service outlets.

3. Use of the Website

You may use the Website for lawful purposes only. You agree not to:

  • Use the Website in any way that breaches any applicable local, national or international law or regulation;
  • Attempt to gain unauthorised access to any part of the Website, the server on which it is stored, or any server, computer or database connected to the Website;
  • Transmit any viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful;
  • Reproduce, duplicate, copy or re-sell any part of the Website in contravention of these Terms;
  • Use any automated system (including robots, spiders or scrapers) to access the Website without our prior written consent.

We reserve the right to suspend or terminate your access to the Website at any time without notice if we reasonably believe you have breached these Terms.

4. Products & Sales Channels

We sell fresh soft fruit (strawberries, raspberries, blackberries, blueberries, gooseberries, cherries and seasonal varieties), frozen fruit, homemade jams and marmalades, and may from time to time offer related produce or value-added items.

Sales channels include:

  • Roadside sales units / stands located throughout Ireland (typically operating May–October);
  • Direct sales at the farm premises in Co. Wexford;
  • Wholesale supply to retailers, supermarkets, food-service and other trade customers;
  • Corporate event catering and fruit-based offerings (smoothies, fruit cups, crepes, etc.).

Availability of specific fruits and sizes is seasonal and subject to weather, growing conditions and harvest. We do not guarantee continuous availability of any particular variety or pack size.

5. Pricing, Payment & Orders

Pricing: Prices for roadside and farm sales are as displayed at the point of sale. Wholesale and trade prices are as agreed in writing or as per our current trade price list. All prices are in Euro (€) and include VAT where applicable unless otherwise stated.

Payment: We accept cash and contactless/card payments at our roadside units and farm. Wholesale customers may be offered account terms subject to credit approval. We reserve the right to refuse any order or payment method at our discretion.

Orders: For wholesale or bulk orders, confirmation (email, phone or written) constitutes a binding order once accepted by us. We may require a deposit for large or custom orders.

You are responsible for providing accurate delivery or collection details. Risk in the goods passes to you upon collection or delivery (as applicable).

6. Fresh Produce – Quality, Condition & Returns

Important – Perishable Goods: Fresh soft fruit is highly perishable. We take great care to pick, pack and transport our produce at peak quality, but once it leaves our control we cannot guarantee shelf life.

We warrant that at the time of sale/collection/delivery our fruit will:

  • Be of satisfactory quality and fit for purpose;
  • Correspond with any description given;
  • Comply with applicable Irish and EU food safety and labelling requirements;
  • Be produced under our Bord Bia SHAS and Origin Green standards.

Inspection: Please inspect produce carefully at the point of purchase or delivery. Any issues with quality, quantity or damage should be reported to us immediately (ideally on the same day) by phone or email with supporting photos where possible.

Returns & Refunds: Due to the perishable nature of soft fruit, we generally cannot accept returns of opened or used produce. Where produce is proven to have been defective at the time of sale (e.g. mould, severe bruising, incorrect variety), we will, at our option, replace the goods free of charge or issue a full or partial refund. This does not affect your statutory rights under the Consumer Rights Act 2022 and related Irish consumer protection legislation.

We are not liable for deterioration caused by improper storage, transport delays after delivery, extreme weather after purchase, or normal ripening after sale.

7. Corporate Events & Catering Services

Where we provide catering, fruit bars, smoothies, crepes or other services for corporate or private events:

  • Bookings are subject to availability and confirmation by us in writing or by email;
  • A deposit may be required to secure the date;
  • Cancellation by you within 7 days of the event may result in forfeiture of the deposit and/or a cancellation fee to cover costs incurred;
  • We will use reasonable endeavours to provide the agreed service but reserve the right to make reasonable substitutions of fruit varieties due to seasonality or supply issues;
  • You are responsible for providing suitable access, power (if required), and a safe working area for our staff and equipment.

Full details of any event booking will be confirmed separately and form part of the contract between us.

8. Intellectual Property

All content on the Website (including text, photographs, logos, graphics, layout and design) is owned by or licensed to Greenhill Fruit Farm Limited and is protected by Irish and international copyright and trade mark laws.

You may view, download and print pages from the Website for your personal, non-commercial use only. You may not reproduce, modify, distribute, or use any content for commercial purposes without our prior written consent.

Our name, logo and branding may not be used without our express written permission.

9. Limitation of Liability

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence;
  • Fraud or fraudulent misrepresentation;
  • Any other liability that cannot be excluded or limited by Irish law.

Subject to the above, to the fullest extent permitted by law:

  • We shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or business opportunity arising out of or in connection with the Website, our products or our services;
  • Our total aggregate liability arising out of or in connection with any purchase or these Terms shall not exceed the total amount paid by you for the relevant goods or services;
  • We are not responsible for any allergic reactions or dietary issues arising from consumption of our produce. Customers with allergies (including but not limited to fruit, nuts, dairy used in toppings, etc.) must make their own enquiries and decisions. While we take care with production, our farm and packing facilities handle multiple fruit types.

The Website is provided on an “as is” and “as available” basis. We do not warrant that the Website will be uninterrupted, error-free, or free of viruses.

10. Indemnity

You agree to indemnify, defend and hold harmless Greenhill Fruit Farm Limited, its directors, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in any way connected with your breach of these Terms or your use of the Website or our products/services.

11. Privacy

Any personal data we collect (for example via contact forms, event bookings, wholesale accounts or marketing) will be processed in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Acts 1988–2018 (Ireland). Please see our Privacy Policy (if published) or contact us for further information about how we handle your data.

We do not sell personal data. Contact details provided for enquiries or orders will be used only for the purpose for which they were given and legitimate business communications.

We may update these Terms from time to time. The “Last updated” date at the top of this page will be revised accordingly. Continued use of the Website or purchase of our products after changes constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

13. Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of Ireland.

The courts of Ireland shall have exclusive jurisdiction to settle any such dispute or claim.

15. Severability & Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

These Terms (together with any specific order confirmation or event booking agreement) constitute the entire agreement between you and us in relation to the subject matter and supersede any prior agreements or understandings.
